Trust administration is the process of managing and distributing trust assets based on the rules in the trust document as well as Florida law, either while the person who created the trust is alive or after they have passed.
Estate planning is simply deciding how your property is handled while you are alive and after your death and, if appropriate, who would be the guardian for your minor children. We will carefully guide you through this process and give you peace of mind.
A guardianship is established when a person is unable to properly care for themselves or their assets. It is designed to protect and exercise the legal rights of people who are incapacitated due to specific illnesses or are under the age of 18.
Guardian advocacy is a type of guardianship for individuals over the age of eighteen with intellectual or specific developmental disabilities. It is an option if that person cannot use other legal alternatives for decision-making.
Special Needs Trusts are used to improve the quality of life for people with disabilities while protecting eligibility for government benefits. It is often part of comprehensive estate planning and could be appropriate for people with any disability: intellectual, developmental, or physical.
Minor settlements occur when a child is injured, and the case resolves through settlement rather than a trial. Florida law requires court approval for settlements for children under the age of 18 that exceed $15,000.
Litigation is a court proceeding arising from a conflict or dispute between parties to a case. We handle litigation connected to probate, trust administration, and guardianship, in addition to general civil litigation.
Attorney Kimberly Lorenz provides mediation services to help parties avoid the cost, delay, uncertainty, and risk of trial by empowering them to minimize exposure through further discovery and litigation and to craft creative solutions beyond monetary damages in reaching a resolution.
